Eski kirac\u0131 ve yeni kirac\u0131 aras\u0131ndaki bu kira farklar\u0131n\u0131n meydana gelmesi ile birlikte mal sahibi ve kirac\u0131lar aras\u0131nda ihtilaflar ortaya \u00e7\u0131kmaya ba\u015flam\u0131\u015ft\u0131r. Bu nedenle her iki tarafta yap\u0131lan kira s\u00f6zle\u015fmesine uygun olarak kira bedelllerinde g\u00fcncelleme yapmak istemektedir.<\/p>\n<p>Hakl\u0131 olarak eski kirac\u0131lar eski kirac\u0131 olman\u0131n haklar\u0131ndan faydalanmak isterken mal sahipleri de fahi\u015f fiyat art\u0131\u015flar\u0131 ile birlikte de\u011ferlenen m\u00fclklerinden ayn\u0131 oranda gelir elde etmek istemektedir.<\/p>\n<p>Bu yaz\u0131m\u0131zda kira art\u0131\u015f oranlar\u0131n\u0131n neye g\u00f6re belirlenmesi gerekti\u011fi ve fahi\u015f kira art\u0131\u015f oran\u0131na kar\u015f\u0131 kirac\u0131n\u0131n haklar\u0131 ya da mal sahibinin kira art\u0131\u015f oran\u0131na uymayan kirac\u0131ya kar\u015f\u0131 nas\u0131l bir yol izlemesi gerekti\u011fini ve kira s\u00f6zle\u015fmesinde belirlenen kira bedelinin nas\u0131l g\u00fcncellenmesi gerekti\u011fini<span class=\"Apple-converted-space\">\u00a0 <\/span>k\u0131saca a\u00e7\u0131klamak istiyoruz.<\/p>\n<h3><b>Kirac\u0131 Mal Sahibinin Kira Art\u0131\u015f Talebini Kabul Etmek Zorunda m\u0131? <\/b><\/h3>\n<p>Hem kirac\u0131 hem de kiraya veren kira s\u00f6zle\u015fmesinde kira bedelini ve kira bedelinin hangi oranda artaca\u011f\u0131n\u0131 serbest\u00e7e kararla\u015ft\u0131rabilirler. Fakat kirac\u0131 ve kiraya veren bu art\u0131\u015f oran\u0131n\u0131 belirlemede tamamen serbest de\u011fildir. Kira art\u0131\u015f oran\u0131n\u0131n yasal s\u0131n\u0131r\u0131 T\u00fcrk Bor\u00e7lar Kanunu ilgili maddesinde<span class=\"Apple-converted-space\">\u00a0 <\/span>belirlenmi\u015ftir. Bu yasal s\u0131n\u0131r bir \u00f6nceki kira y\u0131l\u0131n\u0131n t\u00fcketici fiyat endeksindeki oniki ayl\u0131k ortalamas\u0131na g\u00f6re hesaplanmaktad\u0131r. Bu ortalamay\u0131 ge\u00e7memek ko\u015fuluyla kira bedelinde art\u0131\u015f yap\u0131labilir. E\u011fer kira s\u00f6zle\u015fmesinde bu art\u0131\u015f oran\u0131ndan fazla bir art\u0131\u015f oran\u0131 belirlendiyse art\u0131\u015f s\u00f6zle\u015fmede belirlenen oran \u00fczerinden yap\u0131lamaz. T\u00dcFE de\u011ferleri dikkate al\u0131narak art\u0131\u015f yap\u0131lmas\u0131 gerekmektedir. \u00d6rne\u011fin ; kira s\u00f6zle\u015fmesinde kira bedeli 1.000,00 TL olarak belirlenmi\u015f ve kira art\u0131\u015f oran\u0131 %15 olarak belirlendiyse ve bir \u00f6nceki kira y\u0131l\u0131n\u0131n T\u00dcFE de\u011ferinin %10 olarak tespit edilmesi durumunda art\u0131\u015f T\u00dcFE de\u011ferine g\u00f6re yap\u0131lacakt\u0131r. Yani kira bedelinde art\u0131\u015f<span class=\"Apple-converted-space\">\u00a0 <\/span>%15 olarak<span class=\"Apple-converted-space\">\u00a0 <\/span>de\u011fil , %10 olarak yap\u0131lacakt\u0131r. Bu durumda yeni kira d\u00f6neminde kira bedeli 1.100,00 TL olarak belirlenecektir.<\/p>\n<p>E\u011fer kiraya veren kirac\u0131dan, s\u00f6zle\u015fmede ve T\u00dcFE de\u011ferlerine g\u00f6re belirlenen kira bedelinden fazla kira bedeli talep ediyorsa kirac\u0131 bu bedeli \u00f6demek zorunda de\u011fildir. Fakat bu durumda kiraya veren ilams\u0131z bir takip ba\u015flatabilir. Bu durumda kirac\u0131n\u0131n s\u00fcresi i\u00e7erisinde ilams\u0131z takibe itiraz etmesi gerekir.<\/p>\n<p>Kira s\u00f6zle\u015fmesinde art\u0131\u015f oran\u0131 belirlenmemi\u015f ve kiraya veren<span class=\"Apple-converted-space\">\u00a0 <\/span>yeni d\u00f6nemde fahi\u015f bir kira art\u0131\u015f oran\u0131 talep ediyorsa bu durumda kirac\u0131, T\u00fcrk Bor\u00e7lar Kanunu ilgili maddesi gere\u011fi \u201ckira tespit davas\u0131\u201d a\u00e7abilir. Bu durumda kira art\u0131\u015f oran\u0131 hakim taraf\u0131ndan belirlenecektir.Bu noktada hakim de T\u00dcFE de\u011ferleri, emsal kira bedelleri ve kiralanan\u0131n durumunu dikkate alarak art\u0131\u015f oran\u0131 belirleyecektir.<\/p>\n<h3><b>Kira S\u00f6zle\u015fmesinin 5 Y\u0131l\u0131 Ge\u00e7mesi Halinde Mal Sahibi ve Eski Kirac\u0131n\u0131n Durumu<\/b><\/h3>\n<p>Kirac\u0131n\u0131n ya da kiraya verenin izleyece\u011fi di\u011fer bir yol ise ; T\u00fcrk Bor\u00e7lar Kanunu ilgili maddesinde belirlenmi\u015ftir. Kira s\u00f6zle\u015fmesinin 5 y\u0131ldan uzun s\u00fcreli olmas\u0131 halinde veya 5 y\u0131ldan sonra<span class=\"Apple-converted-space\">\u00a0 <\/span>yenilenen kira s\u00f6zle\u015fmesi s\u00f6z konusu oldu\u011funda, kira art\u0131\u015f oran\u0131nda anla\u015fma yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131na bak\u0131lmaks\u0131z\u0131n her iki taraf da kira bedelinin tespitinin hakim taraf\u0131ndan yap\u0131lmas\u0131n\u0131 isteyebilir. Bu durumda hakim emsal kira de\u011ferlerini ve T\u00dcFE oranlar\u0131n\u0131 dikkate alarak yeni kira d\u00f6nemi i\u00e7in kira bedelini tespit eder.<\/p>\n<p>Kirac\u0131 e\u011fer zor durumda kalm\u0131\u015fsa ve art\u0131k kiras\u0131n\u0131 \u00f6deyemez halde ise T\u00fcrk Bor\u00e7lar Kanunu kirac\u0131ya bir hak daha tan\u0131maktad\u0131r. Bu hak, T\u00fcrk Bor\u00e7lar Kanunu 138.maddesinde \u201c A\u015f\u0131r\u0131 \u0130fa G\u00fc\u00e7l\u00fc\u011f\u00fc \u201c ba\u015fl\u0131\u011f\u0131 alt\u0131nda d\u00fczenlenmi\u015ftir.Bu kanun maddesi kiras\u0131n\u0131 \u00f6demede g\u00fc\u00e7 duruma d\u00fc\u015fen kirac\u0131ya uyarlama davas\u0131 a\u00e7ma imkan\u0131 tan\u0131maktad\u0131r. Fakat uyarlama davas\u0131nda \u015fartlar\u0131n\u0131n olu\u015fup olu\u015fmad\u0131\u011f\u0131n\u0131 ayr\u0131ca incelemek gerekmektedir.<\/p>\n<h3><b>Mal sahibi Kira Art\u0131\u015f\u0131 Yapmayan Eski Kirac\u0131ya Kar\u015f\u0131 Ne Yapabilir?<\/b><\/h3>\n<p>Kirac\u0131 ,kira s\u00f6zle\u015fmesinde kira art\u0131\u015f oran\u0131 belirlenmesine ra\u011fmen<span class=\"Apple-converted-space\">\u00a0 <\/span>s\u00f6zle\u015fmede belirlenen kira art\u0131\u015f oran\u0131na<span class=\"Apple-converted-space\">\u00a0 <\/span>uymadan kira bedelini \u00f6d\u00fcyorsa bu durumda kiraya veren kirac\u0131ya kar\u015f\u0131<span class=\"Apple-converted-space\">\u00a0 <\/span>ilams\u0131z icra takibi ba\u015flatabilir.Bu \u015fekilde kiraya veren kira alaca\u011f\u0131n\u0131<span class=\"Apple-converted-space\">\u00a0 <\/span>tahsil edebilir.<\/p>\n<p>Di\u011fer bir yasal yol ise T\u00fcrk Bor\u00e7lar Kanunu ilgili maddesi gere\u011fi kira bedelini \u00f6demeyen kirac\u0131ya kar\u015f\u0131 iki hakl\u0131 ihtar ile s\u00f6zle\u015fme feshedilebilir ve tahliye davas\u0131 a\u00e7abilir.<\/p>\n<p>E\u011fer kira art\u0131\u015f oran\u0131n\u0131 s\u00f6zle\u015fmede belirlenmemi\u015f ise kiraya veren hakimdem kira bedelinin belirlenmesi i\u00e7in \u201c kira bedeli tespit \u201c davas\u0131 a\u00e7abilir ve kira bedelinin hakim taraf\u0131ndan belirlenmesini isteyebilir.<\/p>\n<p>Kirac\u0131 emsal kira bedellerine g\u00f6re daha d\u00fc\u015f\u00fck bir kira bedeli \u00f6d\u00fcyorsa ve durum kiraya vereni olumsuz etkilemekte ise, bu durumda kiraya veren kira uyarlama davas\u0131 a\u00e7arak kira bedelinin tekrardan belirlenmesini talep edebilir. Hakim bu durumda emsal kira bedelleri , T\u00dcFE de\u011ferleri ve kiralanan\u0131n durumu dikkate alarak yeni kira bedeli belirleyecektir.<\/p>\n<h3><b>Sonu\u00e7<\/b><\/h3>\n<p>Kiraya veren ve kirac\u0131 yasal yollar \u00e7er\u00e7evesinde serbest\u00e7e kira art\u0131\u015f oranlar\u0131n\u0131 ve kira bedellerini belirleyebilirler.
