Ev sahiplerinin de hem ge\u00e7im hem de yat\u0131r\u0131m ara\u00e7lar\u0131 gayrimenkulleridir. Y\u00fcksek enflasyon ve hayat pahal\u0131l\u0131\u011f\u0131 nedeniyle ev sahiplerinin de kira bedellerine zam yapma zarureti do\u011fmu\u015ftur. (www.zingat.com)<\/p>\n<p>T\u00fcrk Bor\u00e7lar Kanunu\u2019na g\u00f6re kira art\u0131\u015f oran\u0131 bir \u00f6nceki kira y\u0131l\u0131nda t\u00fcketici fiyat endeksindeki oniki ayl\u0131k ortalamas\u0131n\u0131 ge\u00e7emez. Yani ev sahibi T\u00dcFE\u2019den daha fazla zam yapamaz. Ancak gelinen noktada art\u0131k bu enflasyon oranlar\u0131na g\u00f6re zam yap\u0131lsa bile kira bedelleri rayi\u00e7 bedeller alt\u0131nda \u00e7ok komik kalmaktad\u0131r. Bu nedenle bir\u00e7ok ev sahibi mevcut kirac\u0131y\u0131 \u00e7\u0131kar\u0131p rayi\u00e7 bedeller \u00fczerinden evini yeniden kiraya vermek istemektedir. Mevcut kirac\u0131y\u0131 tahliye etmenin yollar\u0131 \u015fu \u015fekildedir.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<h3><b>GE\u00c7M\u0130\u015eE D\u00d6N\u00dcK K\u0130RA FARKINI \u0130STEY\u0130N<\/b><\/h3>\n<p>T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 315\/II maddesine g\u00f6re bir kirac\u0131 kira bedelini 30 g\u00fcn i\u00e7erisinde \u00f6demek zorundad\u0131r. E\u011fer 30 i\u00e7erisinde \u00f6deme yapmazsa icra takibi yap\u0131l\u0131r ve bor\u00e7luya tebligat g\u00f6nderilir. E\u011fer bu tebligattan sonra da 30 g\u00fcn i\u00e7erisinde \u00f6deme yapmazsa icra hukuk mahkemesinde dava a\u00e7\u0131l\u0131r ve kirac\u0131 tahliye edilir.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>Genelde \u00dclkemizde kirac\u0131lar her sene ba\u015f\u0131nda ev sahipleri ile anla\u015f\u0131p bir kira bedelini belirlerler. Yani s\u00f6zle\u015fmede yazan oran\u0131n alt\u0131ndaki bir rakamda anla\u015f\u0131rlar. Bunun d\u0131\u015f\u0131nda bir\u00e7ok kirac\u0131 T\u00dcFE oran\u0131 ya da s\u00f6zle\u015fmedeki oran\u0131 uygulasa bile \u00f6denecek bedeli yuvarlama yoluna giderler. \u00d6rne\u011fin %19,83\u2019l\u00fck bir enflasyon sonucunda kira bedeli 3.839 TL olmas\u0131 gerekirken d\u00fcz hesap 3.850 TL \u00f6derler. B\u00f6yle olunca da asl\u0131nda her ay \u00f6denmesi gereken bedelden 39 TL eksik \u00f6denmi\u015f olur. \u00d6zellikle uzun s\u00fcreli kira ili\u015fkilerinde bu fark daha da b\u00fcy\u00fck olur. Ev sahibinin eksik \u00f6deme almas\u0131 ve buna itiraz etmemesi bu kira bedelini kabul etti\u011fi anlam\u0131na gelmez. Yarg\u0131tay\u2019\u0131n bu konu hakk\u0131nda \u00e7ok fazla karar\u0131 vard\u0131r. Ev sahibi \u00f6rne\u011fin 5 sene bu \u015fekilde kira bedelini al\u0131p 5. Senenin sonunda aradaki t\u00fcm fark\u0131 faizi ile birlikte isteyebilir. Kirac\u0131 bu fark\u0131 \u00f6demezse icra takibi yap\u0131l\u0131r. Kirac\u0131 bu icra takibinden sonra 30 g\u00fcn i\u00e7inde kira bedelini \u00f6demezse icra hukuk mahkemesinde dava a\u00e7\u0131larak ev tahliye ettirilebilir. Yarg\u0131tay 35 Kuru\u015f eksik yap\u0131lan eksik \u00f6demeyi dahi tahliye sebebi saymaktad\u0131r. (Yarg\u0131tay Alt\u0131nc\u0131 Hukuk Dairesi&#8217;nin 2015\/6655E., 2015\/10585K. say\u0131l\u0131 ve 01.12.2015 tarihli karar\u0131)<\/p>\n<h3><b>EV\u0130N\u0130Z\u0130 \u0130HT\u0130YA\u00c7 VEYA TAD\u0130LAT SEBEB\u0130YLE TAHL\u0130YE EDEB\u0130L\u0130S\u0130N\u0130Z<\/b><\/h3>\n<p>Ev sahiplerinin kirac\u0131lar\u0131n\u0131 tahliye ederken kullanabilece\u011fi di\u011fer etkili yollardan bir tanesi de ihtiya\u00e7 ya da tadilat sebebiyle tahliye talebidir. Ev sahibi<b>; <\/b>e\u015fi, altsoyu, \u00fcstsoyu veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filer i\u00e7in ev veya i\u015fyeri gerekirse kirac\u0131s\u0131n\u0131 tahliye edebilir. Bunun i\u00e7in fesih s\u00fcrelerine uyulmas\u0131 ve s\u00f6zle\u015fmenin bitim tarihinden itibaren 1 ay i\u00e7inde sulh hukuk mahkemesinde dava a\u00e7\u0131lmas\u0131 gerekir. \u00d6rne\u011fin 1 Kas\u0131m 2021 tarihinde 1 y\u0131ll\u0131k yap\u0131lan bir kira s\u00f6zle\u015fmesi oldu\u011funu d\u00fc\u015f\u00fcnelim. Bu s\u00f6zle\u015fmenin bitim tarihi 15 Kas\u0131m 2022 tarihidir. Ev sahibi s\u00f6zle\u015fmenin bitim tarihinden 3 ay \u00f6nce yani 15 A\u011fustos 2022 tarihinden \u00f6nce s\u00f6zle\u015fmeyi ihtiya\u00e7 nedeniyle feshetti\u011fini kirac\u0131ya bildirmelidir. E\u011fer kirac\u0131 evi 15 Kas\u0131m 2021 tarihinde teslim etmezse ev sahibi 1 ay i\u00e7inde yani 15 Aral\u0131k 2022 tarihine kadar tahliye davas\u0131 a\u00e7arak evi tahliye edebilir. Dava sulh hukuk mahkemesinde a\u00e7\u0131l\u0131r.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<h3><b>YEN\u0130 MAL\u0130K DE EV\u0130 TAHL\u0130YE EDEB\u0130L\u0130R<\/b><\/h3>\n<p>T\u00fcrk Bor\u00e7lar Kanunu\u2019na g\u00f6re yeni malik sat\u0131n ald\u0131\u011f\u0131 evi kendisi, e\u015fi, altsoyu, \u00fcstsoyu veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filer i\u00e7in tahliye ettirebilir. Bunun i\u00e7in yeni malik evi ald\u0131\u011f\u0131 tarihten itibaren kirac\u0131ya bir ihtarname g\u00f6ndermelidir. Bu ihtarnamede evi yeni ald\u0131\u011f\u0131n\u0131, bu eve kendisinin veya Kanunda say\u0131lan yak\u0131nlar\u0131ndan birinin ihtiyac\u0131n\u0131n oldu\u011funu belirtmesi gerekir. Ayr\u0131ca ihtarnamenin ekine yeni tapu belgesinin bir \u00f6rne\u011fi de eklenir. E\u011fer kirac\u0131 evi tahliye etmezse yeni malik dava a\u00e7abilir. Ancak bu davay\u0131 evi ald\u0131ktan 6 ay sonra a\u00e7abilir. Bu dava da sulh hukuk mahkemesinde a\u00e7\u0131l\u0131r. \u015eayet yeni malik 1 ay i\u00e7inde ihtarname g\u00f6ndermezse bu hakk\u0131n\u0131 kaybeder ve eski malikten bir fark\u0131 kalmaz. Bu nedenle her ihtimale kar\u015f\u0131 i\u00e7inde kirac\u0131 olan ev sat\u0131n alanlar mutlaka bu ihtarnameyi g\u00f6ndermelidir.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>Uygulamada baz\u0131 ki\u015filerce yeni malikin tahliye hakk\u0131 \u00fczerinden kirac\u0131s\u0131n\u0131 tahliye etmeye \u00e7al\u0131\u015fanlar da bulunmaktad\u0131r. Yukar\u0131da anlat\u0131ld\u0131\u011f\u0131 \u00fczere bir malikin ihtiya\u00e7 sebebiyle s\u00f6zle\u015fmeyi feshedebilmesi i\u00e7in s\u00f6zle\u015fmenin s\u00fcresinin sona ermesi gerekir. 1 y\u0131ll\u0131k kira s\u00f6zle\u015fmelerinde bir problem olmasa da 3,5 veya 10 y\u0131ll\u0131k s\u00f6zle\u015fmelerde ev sahibinin ihtiya\u00e7 sebebiyle tahliye etmesi i\u00e7in s\u00f6zle\u015fmenin s\u00fcresini bekleyebilmesi \u00e7ok zordur. Hal b\u00f6yle olunca baz\u0131 ki\u015filerce muvazaal\u0131 sat\u0131\u015flar yap\u0131lmakta ve evi sat\u0131n alm\u0131\u015f gibi hareket eden yeni malik \u00fczerinden tahliye davas\u0131 a\u00e7\u0131lmaktad\u0131r. \u015eayet kirac\u0131 taraf\u00e7a bu muvazaa kan\u0131tlanamazsa ev tahliye edilmektedir. Evin rayi\u00e7 bedelinin banka hesaplar\u0131 yoluyla \u00f6dendi\u011fi bir muvazaal\u0131 yani sahte bir sat\u0131\u015fta bu muvazaay\u0131 kan\u0131tlamak hi\u00e7 de kolay de\u011fildir. Bu nedenle kirac\u0131 aleyhine tahliye kararlar\u0131 verilmektedir.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<h3><b>\u0130HT\u0130YA\u00c7 SEBEB\u0130YLE TAHL\u0130YEDE K\u0130RACININ TAZM\u0130NAT HAKKI<\/b><\/h3>\n<p>\u0130htiya\u00e7 sebebiyle tahliyelerde e\u011fer tahliye edilen ev ihtiyac\u0131 oldu\u011fu belirtilen ki\u015fi veya ki\u015filer taraf\u0131ndan kullan\u0131lmazsa kirac\u0131 taraf bu durumu tespit edip tazminat davas\u0131 a\u00e7abilir. Bu tazminat miktar\u0131 1 y\u0131ll\u0131k kira bedelidir. G\u00fcn\u00fcm\u00fczde eski kirac\u0131lar\u0131n \u00f6dedi\u011fi kira bedeli ile rayi\u00e7 bedel aras\u0131ndaki derin u\u00e7urum g\u00f6z \u00f6n\u00fcne al\u0131nd\u0131\u011f\u0131nda eski kira bedeli \u00fczerinden 1 y\u0131ll\u0131k tazminat yeni kira bedelleri yan\u0131nda k\u00fc\u00e7\u00fck bir mebla\u011f olarak kalmaktad\u0131r.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<h3><b>TAHL\u0130YE TAAHH\u00dcNAMES\u0130 HER ZAMAN \u0130\u015e\u0130N\u0130ZE YARAYAB\u0130L\u0130R.<span class=\"Apple-converted-space\">\u00a0<\/span><\/b><\/h3>\n<p>T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 352\/I maddesine g\u00f6re kirac\u0131 ev sahibine hitaben evi bo\u015faltaca\u011f\u0131n\u0131 belirten bir taahh\u00fctname verebilir. Uygulamada \u00f6zellikle kira s\u00f6zle\u015fmesinin imzalanmas\u0131 s\u0131ras\u0131nda ev sahipleri taraf\u0131ndan bir \u00f6n \u015fart olarak tahliye taahh\u00fctnamesi kirac\u0131ya imzalat\u0131lmaktad\u0131r. Uygulamada genellikle taahh\u00fctnamenin tahliye tarihinin bo\u015f b\u0131rak\u0131ld\u0131\u011f\u0131 ve ev sahibine istedi\u011fi zaman bu tarihi doldurup tahliye talep etme hakk\u0131 tan\u0131nd\u0131\u011f\u0131 g\u00f6r\u00fclmektedir. Yarg\u0131tay Hukuk Genel Kurulu da tahliye taahh\u00fctnamesinin bo\u015f tarihle verilmesi durumunda kirac\u0131n\u0131n bu duruma katlanmas\u0131 gerekti\u011fi y\u00f6n\u00fcnde kararlar vermi\u015ftir.<span class=\"Apple-converted-space\">\u00a0 <\/span>(Yarg\u0131tay Hukuk Genel Kurulu\u2019nun E. 2014\/8-1422 K. 2015\/1107 T. 27.3.2015 say\u0131l\u0131 karar\u0131)<\/p>\n<p>Tahliye taahh\u00fctnamesinin tarihi her zaman kira s\u00f6zle\u015fmesinden daha ileri bir tarih olmal\u0131d\u0131r. Aksi takdirde mahkemeler ve Yarg\u0131tay taraf\u0131ndan kabul edilmemektedir. Ev sahibi taahh\u00fctnamedeki tarihten itibaren 1 ay i\u00e7erisinde icra takibi ya da dava yoluyla bu hakk\u0131n\u0131 kullanabilir.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<h3><b>EV SAH\u0130B\u0130 \u0130K\u0130 HAKLI \u0130HTARLA TAHL\u0130YE DAVASI A\u00c7MAYA HAK KAZANIR<\/b><\/h3>\n<p>G\u00fcn\u00fcm\u00fczde bu usul\u00fc bir\u00e7ok ki\u015fi bildi\u011fini d\u00fc\u015f\u00fcnse de sanki iki hakl\u0131 ihtar sonucunda ev sahibi kendi eliyle gayrimenkul\u00fc do\u011frudan tahliye edebilecektir \u015feklinde yanl\u0131\u015f bir alg\u0131 bulunmaktad\u0131r. Ancak TBK 352\/II maddesine g\u00f6re 1 kira y\u0131l\u0131 i\u00e7inde kirac\u0131 kiray\u0131 iki kez \u00f6demez ve her \u00f6demedi\u011finde ev sahibi yaz\u0131l\u0131 ihtarname ke\u015fide etmi\u015fse bu durum ev sahibine dava a\u00e7ma hakk\u0131 sa\u011flar. Ev sahibi kira s\u00f6zle\u015fmesinin bitiminden itibaren 1 ay i\u00e7inde sulh hukuk mahkemesine dava a\u00e7abilir.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<h3><b>K\u0130RACININ VEYA E\u015e\u0130N\u0130N AYNI \u0130L\u00c7EDE EV\u0130 VARSA K\u0130RACIYI TAHL\u0130YE EDEB\u0130L\u0130RS\u0130N\u0130Z<\/b><\/h3>\n<p>T\u00fcrk Bor\u00e7lar Kanunu\u2019na g<b>\u00f6re <\/b>kirac\u0131n\u0131n veya birlikte ya\u015fad\u0131\u011f\u0131 e\u015finin ayn\u0131 il\u00e7e veya belde belediye s\u0131n\u0131rlar\u0131 i\u00e7inde oturmaya elveri\u015fli bir konutu bulunmas\u0131 durumunda ev sahibi kira s\u00f6zle\u015fmesinin kurulmas\u0131 s\u0131ras\u0131nda bunu bilmiyorsa, s\u00f6zle\u015fmenin bitiminden ba\u015flayarak bir ay i\u00e7inde s\u00f6zle\u015fmeyi dava yoluyla sona erdirebilir. Yani yine kira s\u00f6zle\u015fmesinin biti\u015fi beklenmelidir.
