Aile konutu \u015ferhi ise, evlilik birli\u011finde bir e\u015fin di\u011ferinin r\u0131zas\u0131n\u0131 almaks\u0131z\u0131n aile konutuyla ilgili baz\u0131 hukuki i\u015flemleri (kiralama vb.) yapabilmesini engelleyen bir t\u00fcr \u015ferhtir. <strong>Aile konutu \u015ferhi \u00f6zellikle e\u015flerin bu konut \u00fczerindeki haklar\u0131n\u0131n korunmas\u0131 a\u00e7\u0131s\u0131ndan b\u00fcy\u00fck \u00f6nem te\u015fkil etmektedir.<\/strong><\/p>\n<p><strong>Aile Konutu \u015eerhi Koyman\u0131n Faydas\u0131 Nedir?<\/strong><\/p>\n<p>Aile konutu \u015ferhi \u00f6zellikle 3.ki\u015filerle ilgili uyu\u015fmazl\u0131klarda di\u011fer e\u015fin aile konutu \u00fczerindeki hakk\u0131n\u0131n korunmas\u0131 a\u00e7\u0131s\u0131ndan \u00f6nemlidir. Keza bu \u015ferh olmasa dahi mahkemede ispatlanmas\u0131 ko\u015fuluyla da bu hak korunabilir. Ancak \u015ferh koyulmu\u015fsa ve e\u015flerden biri di\u011ferinin r\u0131zas\u0131 d\u0131\u015f\u0131nda 3.ki\u015filerle bir hukuki i\u015flem (kiralama, sat\u0131n alma vb.) yapm\u0131\u015fsa ma\u011fdur olan e\u015f mahkemeye ba\u015fvurdu\u011funda kar\u015f\u0131 taraf savunmas\u0131nda iyi niyetli oldu\u011funu ya da bu izinden haberi olmad\u0131\u011f\u0131n\u0131 \u00f6ne s\u00fcremez. Zira e\u015f ile 3.ki\u015fi \u015ferhlenmi\u015f aile konutu \u00fczerinde bir hukuki i\u015flem yapt\u0131\u011f\u0131nda tapu m\u00fcd\u00fcrl\u00fc\u011f\u00fcne ba\u015fvurmak zorundad\u0131r ve ba\u015fvurdu\u011funda ise bu konut \u00fczerinde var olan \u015ferhi g\u00f6rmemesi veya bilmemesi imkans\u0131zd\u0131r. Dolay\u0131s\u0131yla 3.ki\u015filer aile konutu \u00fczerinde birtak\u0131m haklara sahibi olarak g\u00f6r\u00fcnse de bu \u015ferh sayesinde ma\u011fdur e\u015f hakk\u0131n\u0131 geri alabilmektedir.<\/p>\n<p><strong>\u00a0Aile Konutu \u015eerhi Nas\u0131l Konulabilir?<\/strong><\/p>\n<p>Aile konutu \u015ferhinin konabilmesi i\u00e7in e\u015flerden birinin tapu m\u00fcd\u00fcrl\u00fc\u011f\u00fcne ba\u015fvurmas\u0131 yeterlidir. Bu m\u00fcd\u00fcrl\u00fckler ba\u015fvuran e\u015ften evlilik c\u00fczdan\u0131, aile konutu \u015ferhi dilek\u00e7esi ve konutun aile konutu oldu\u011funa dair belgeler gibi birtak\u0131m evraklar ister. Bu i\u015flemler tamamland\u0131ktan sonra ise aile konutu art\u0131k \u015ferhlenmi\u015f olur. Bu durumda mahkeme durumu tapu m\u00fcd\u00fcrl\u00fc\u011f\u00fcne bildirecektir.<\/p>\n<p><strong>Aile Konutu \u015eerhi Olmayan Ev Sat\u0131labilir Mi?<\/strong><\/p>\n<p>Daha \u00f6nce \u015ferh koyulmam\u0131\u015f bir aile konutunun sat\u0131\u015f\u0131nda r\u0131zas\u0131 bulunmayan e\u015f bu evi iyi niyetli olmayarak sat\u0131n alm\u0131\u015f olan ki\u015fiye kar\u015f\u0131 tapu iptal davas\u0131 a\u00e7arak bu evi geri kazanabilir.
