M\u00fccavir alan s\u0131n\u0131rlar\u0131n\u0131n d\u0131\u015f\u0131nda kalan b\u00f6lgelerde bunun i\u00e7in yetkili makam valiliktir. Yap\u0131 ruhsat\u0131n\u0131n al\u0131nd\u0131\u011f\u0131 tarihten itibaren 2 y\u0131l i\u00e7erisinde in\u015faat\u0131n yap\u0131m\u0131na ba\u015flan\u0131lmas\u0131 ve 5 y\u0131l i\u00e7inde in\u015faat\u0131n tamamlanmas\u0131 gerekmektedir. Aksi takdirde yeniden yap\u0131 ruhsat\u0131 al\u0131nmas\u0131 zorunlulu\u011fu do\u011facakt\u0131r. Ruhsat\u0131 olmayan binalar ka\u00e7ak say\u0131lmaktad\u0131r.<\/p>\n<p>\u0130skan belgesi olarak da adland\u0131r\u0131lan yap\u0131 kullanma izin belgesi ise in\u015faat\u0131n y\u00f6netmeli\u011fe, projeye ve yap\u0131 ruhsat\u0131na uygun bir \u015fekilde tamamland\u0131\u011f\u0131n\u0131, m\u00fcteahhitin bir borcunun bulunmad\u0131\u011f\u0131n\u0131 g\u00f6stermektedir. \u0130skan, s\u00f6z konusu in\u015faat\u0131n kullan\u0131ma ve oturuma a\u00e7\u0131k oldu\u011funun yetkili belediye ya da valilik taraf\u0131ndan resmen onaylanmas\u0131 sonucunda al\u0131nmaktad\u0131r. B\u00f6ylelikle s\u00f6z konusu in\u015faat\u0131n hukuka uygun bir \u015fekilde tamamlanm\u0131\u015f oldu\u011fu ve g\u00fcvenilirli\u011fi a\u00e7\u0131s\u0131ndan sak\u0131nca bulunmad\u0131\u011f\u0131 anla\u015f\u0131l\u0131r.<\/p>\n<p><strong>Kat \u0130rtifak\u0131 ve Kat M\u00fclkiyeti<\/strong><\/p>\n<p>\u0130n\u015faat\u0131 devam etmekte olan bir binadan ev sat\u0131n almay\u0131 d\u00fc\u015f\u00fcn\u00fcyorsan\u0131z; bir daireyi sat\u0131n alamayaca\u011f\u0131n\u0131z\u0131, arsa pay\u0131 cinsiyle belirlenmi\u015f bir hak elde edece\u011finizi ve tapunuzun niteli\u011finin \u201ckat irtifak\u0131\u201d olaca\u011f\u0131n\u0131 bilmelisiniz. Kat irtifak\u0131, hen\u00fcz tamamlanmam\u0131\u015f bir in\u015faat\u0131n hak sahiplerinin paylar\u0131n\u0131 belirtmektedir.<\/p>\n<p>Buna kar\u015f\u0131n, tamamlanm\u0131\u015f ve belediye\/valilik taraf\u0131ndan oturuma ve kullan\u0131ma a\u00e7\u0131lmas\u0131 onaylanm\u0131\u015f bir binadan ev ald\u0131\u011f\u0131n\u0131zda, do\u011frudan \u201ckat m\u00fclkiyeti\u201d tapusu al\u0131rs\u0131n\u0131z. Tapunuz kat irtifak\u0131 \u00e7e\u015fidindeyse, in\u015faat\u0131n bitimiyle iskan al\u0131nmas\u0131 sonras\u0131nda evinizin tapusunu kat m\u00fclkiyetine ge\u00e7irmeniz m\u00fcmk\u00fcnd\u00fcr ve gereklidir.<\/p>\n<p><strong>\u0130n\u015faat\u0131 Tamamlanmam\u0131\u015f Yap\u0131dan Ev Almak<\/strong><\/p>\n<p>\u0130n\u015faat\u0131 tamamlanmam\u0131\u015f evler daha uygun fiyata sat\u0131lsa dahi b\u00f6yle bir sat\u0131n alma birtak\u0131m olumsuzluklar ve riskler bar\u0131nd\u0131rmaktad\u0131r. \u00d6rne\u011fin, bankalar kat m\u00fclkiyetli tapular\u0131 daha \u00e7ok tercih etti\u011finden konut kredisi almakta sorun ya\u015fayabilirsiniz. Kat irtifak\u0131 tapusu almay\u0131 d\u00fc\u015f\u00fcn\u00fcyorsan\u0131z, benzeri problemlerle kar\u015f\u0131la\u015fmamak ad\u0131na hukuki dan\u0131\u015fmanl\u0131ktan yararlanman\u0131z daha sa\u011fl\u0131kl\u0131 olacakt\u0131r.<\/p>\n<p>Normal s\u00fcre\u00e7te in\u015faat\u0131n tamamlanmas\u0131yla iskan al\u0131nmas\u0131 ve kat irtifak\u0131ndan kat m\u00fclkiyetine ge\u00e7ilmesi gerekmektedir. Yap\u0131 kullan\u0131m belgesi\/ iskan t\u00fcm apartman i\u00e7in al\u0131nd\u0131\u011f\u0131ndan t\u00fcm kat malikleri bir \u00fccrete tabidir. Dolay\u0131yla herkesin onay\u0131 al\u0131nmal\u0131d\u0131r. Bu nedenle b\u00f6yle bir yerden ev ald\u0131\u011f\u0131n\u0131zda tapunuz yine kat irtifak\u0131 niteli\u011finde olacakt\u0131r. Ancak belirtmek gerekir ki, hukuken, tamamlanan bir binada oturulabilmesi ve binan\u0131n kullan\u0131labilmesi i\u00e7in iskan al\u0131nmas\u0131 zorunludur.
