Evleri y\u0131k\u0131lan veya hasar g\u00f6ren insanlar\u0131n b\u00fcy\u00fck bir b\u00f6l\u00fcm\u00fcn\u00fc kirac\u0131lar olu\u015fturuyor, kira ili\u015fkisinin bu durumda devam edip etmeyece\u011fi hususu en \u00e7ok merak edilenler aras\u0131nda. Bununla birlikte ya\u015fanan deprem \u00f6zellikle Marmara gibi deprem riski y\u00fcksek olan b\u00f6lgelerde de endi\u015feye neden oldu. Bu yaz\u0131da kirac\u0131lar\u0131n deprem riski olan evlerine kar\u015f\u0131 ne yapabilece\u011fini ve sahip olduklar\u0131 haklar\u0131 anlatmaya \u00e7al\u0131\u015ft\u0131k.<\/p>\n<p><strong>Kullan\u0131lamaz Durumdaki Binalar <\/strong><\/p>\n<p>Deprem nedeniyle y\u0131k\u0131lan veya a\u011f\u0131r hasar alarak kullan\u0131lamaz duruma gelen binalar i\u00e7in kira ili\u015fkisinin kendili\u011finden sona ermesi s\u00f6z konusu olur. Bu durum kira s\u00f6zle\u015fmesinden kaynaklan\u0131r. Kira s\u00f6zle\u015fmesi ile her iki taraf bor\u00e7 alt\u0131na girer, kiraya verenin evi kullan\u0131labilir durumda tutma borcu vard\u0131r. Evin a\u011f\u0131r hasarl\u0131 olmas\u0131, y\u0131k\u0131lmas\u0131 s\u00f6z konusu oldu\u011funda bu borcun\u00a0 yerine getirilmesi imkans\u0131z hale gelecektir, dolay\u0131s\u0131 ile fesih i\u00e7in bir i\u015flem gerekmeksizin kira s\u00f6zle\u015fmesi sona ermi\u015f olur. Binan\u0131n kullan\u0131lamaz h\u00e2le gelmesinden sonraki s\u00fcre i\u00e7in bir kira borcu s\u00f6z konusu olmaz, ancak bu tarihten \u00f6nceki kullan\u0131m i\u00e7in \u00f6denmemi\u015f kira var ise bunun \u00f6denmesi gerekir.<\/p>\n<p><strong>Yap\u0131 Hasars\u0131z da Olsa Deprem B\u00f6lgesinden Uzakla\u015fmak \u0130steyen Kirac\u0131lar i\u00e7in\u00a0; Ola\u011fan\u00fcst\u00fc Fesih <\/strong><\/p>\n<p>Yap\u0131 depremde az hasar alm\u0131\u015f ya da hasars\u0131z ve oturulabilir bir h\u00e2lde de olsa, depremin yaratt\u0131\u011f\u0131 endi\u015fe nedeniyle kirac\u0131lar b\u00f6lgeden ayr\u0131lmak isteyebilirler, bu durumda kira s\u00f6zle\u015fmesini vaktinden \u00f6nce sonland\u0131rmak i\u00e7in ola\u011fan\u00fcst\u00fc fesih yoluna ba\u015fvurulabilir. Bor\u00e7lar Kanununda\u00a0 yer verilen maddede, ola\u011fan\u00fcst\u00fc feshin ger\u00e7ekle\u015fmesi i\u00e7in kira ili\u015fkisinin devam\u0131n\u0131 \u00e7ekilmez h\u00e2le getiren \u00f6nemli sebeplerin varl\u0131\u011f\u0131 aranm\u0131\u015ft\u0131r. Deprem nedeniyle ya\u015fanan psikolojik travmalar, b\u00f6lgede tekrarlayan depremler gibi nedenler veya yap\u0131n\u0131n oturabilir olmas\u0131na ra\u011fmen az hasarl\u0131 olmas\u0131, kirac\u0131lar i\u00e7in kira ili\u015fkisini \u00e7ekilmez h\u00e2le getirebilir. Bu nedenlere dayanarak ola\u011fan\u00fcst\u00fc fesih yoluyla kira s\u00f6zle\u015fmesi, vaktinden \u00f6nce sonland\u0131r\u0131labilir, ancak bunun i\u00e7in yasal bildirim s\u00fcrelerine uyulmal\u0131d\u0131r. Yasal bildirim s\u00fcresi ta\u015f\u0131nmazlar i\u00e7in 3 ayd\u0131r, dolay\u0131s\u0131 ile somut olaya g\u00f6re kirac\u0131\u00a0 s\u00f6zle\u015fmeyi\u00a0 s\u00fcresi bitmeden feshetmek istiyor ancak ev sahibi buna onay vermiyorsa, bu 3 ayl\u0131k kira tutar\u0131n\u0131n ev sahibine\u00a0 \u00f6denmesi gerekebilir, ev sahibi feshe onay verirse buna gerek kalmayacakt\u0131r.<\/p>\n<p><strong>Deprem B\u00f6lgesi Haricindeki Kirac\u0131lar Evlerinin Riskli Olabilece\u011fini D\u00fc\u015f\u00fcn\u00fcyorsa Ne Yapabilir <em>? <\/em><\/strong><\/p>\n<p>\u00d6ncelikle e\u011fer binada buna ili\u015fkin bir inceleme yap\u0131ld\u0131ysa ve binan\u0131n kesinlikle riskli oldu\u011fu sonucu al\u0131nd\u0131ysa bu durum \u00f6nemli ay\u0131p olarak kabul edilebilir. Kiralanan evde \u00f6nemli bir ay\u0131b\u0131n bulunmas\u0131 Bor\u00e7lar Kanunu h\u00fck\u00fcmlerince s\u00f6zle\u015fmeyi fesih nedenidir. Kirac\u0131lar buna dayanarak kira s\u00f6zle\u015fmesini feshedebilir.<\/p>\n<p>B\u00f6yle bir inceleme yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131 kirac\u0131 taraf\u0131ndan bilinmiyorsa, kirac\u0131lar\u0131n ilgili idareye ba\u015fvurarak sonucun kendisine iletilmesini isteme hakk\u0131 vard\u0131r. \u00d6zellikle ev sahiplerinin yap\u0131n\u0131n riskli oldu\u011funu bilmesine ra\u011fmen bunu kirac\u0131larla payla\u015fmamas\u0131, uygulamada s\u0131kl\u0131kla g\u00f6r\u00fclen bir durumdur, ancak yap\u0131 sa\u011flam olmad\u0131\u011f\u0131 h\u00e2lde bunu kirac\u0131s\u0131na bildirmeyen malik hakk\u0131nda maddi ve manevi tazminat isteminde bulunulabilir.<\/p>\n<p>Son olarak binan\u0131n sa\u011flaml\u0131\u011f\u0131na ili\u015fkin hi\u00e7bir inceleme yap\u0131lmam\u0131\u015f, bu d\u00fc\u015f\u00fcnce yaln\u0131zca binan\u0131n eski olmas\u0131 ya da zeminin sa\u011flam olmamas\u0131 gibi nedenlerden dolay\u0131 bir \u015f\u00fcpheye dayan\u0131yorsa binalara maliklerin iste\u011fi ile deprem dayan\u0131kl\u0131l\u0131k testleri yap\u0131lmaktad\u0131r. Bu testlerin kirac\u0131 taraf\u0131ndan yapt\u0131r\u0131lmas\u0131 m\u00fcmk\u00fcn de\u011fildir, yaln\u0131zca tapuda malik olarak g\u00f6r\u00fcnen ki\u015fi taraf\u0131ndan ba\u015fvurulabilir ve bina y\u00fcksek riskli \u00e7\u0131karsa beraberinde mecburi olarak y\u0131k\u0131m veya g\u00fc\u00e7lendirme karar\u0131 da \u00e7\u0131kar. Kirac\u0131lar\u0131n bu anlamda ev sahibinin r\u0131zas\u0131 olmadan dayan\u0131kl\u0131l\u0131k testi yapt\u0131rmas\u0131 m\u00fcmk\u00fcn olmamaktad\u0131r.<\/p>\n<p>Bu durumun istisnas\u0131 ise \u0130stanbul B\u00fcy\u00fck\u015fehir Belediyesinin ba\u015flatt\u0131\u011f\u0131 bina tespit uygulamas\u0131d\u0131r. Sadece \u0130stanbul genelinde ba\u015flat\u0131lan uygulamada kirac\u0131lara da ba\u015fvuru hakk\u0131 tan\u0131n\u0131yor, ancak di\u011fer deprem dayan\u0131kl\u0131l\u0131k testinden farkl\u0131 olarak inceleme sonucunda bina sa\u011flam \u00e7\u0131kmasa bile y\u0131k\u0131m karar\u0131 verilmiyor, yaln\u0131zca binan\u0131n sa\u011flaml\u0131\u011f\u0131na ili\u015fkin bilgi edinilmesini sa\u011fl\u0131yor.
